A legal disclaimer

1. Introduction

Nairobi Heritage Tours & Safaris (“we,” “us,” or “our”) provides guided tours, excursions, and safari experiences across Kenya. By booking a tour with us, you (“the client” or “guest”) agree to the following Terms & Conditions. Please read them carefully before confirming your reservation.

2. Booking & Payment

2.1 Booking Confirmation

A booking is considered confirmed once:

  • Full payment or the required deposit is received

  • You receive a written confirmation from us

2.2 Payment Methods

We accept:

  • Credit/Debit cards

  • Mobile money (M-Pesa)

  • Bank transfers

  • Approved online booking platforms

All payments must be made in the currency and amount stated during booking.

2.3 Pricing

Prices are displayed per person unless otherwise stated and include only the services listed in the tour description.
Prices may change without notice prior to booking confirmation.

3. Cancellations & Refund Policy

3.1 Cancellations by the Client

  • More than 48 hours before the tour: Full refund

  • 24–48 hours before the tour: 50% refund

  • Less than 24 hours / No-show: No refund

Safari packages and multi-day tours may have stricter policies due to third-party accommodation and park fees.

3.2 Cancellations by the Operator

We may cancel or reschedule a tour due to:

  • Weather conditions

  • Operational or safety concerns

  • Park or attraction closures

  • Minimum group numbers not met

If we cancel, the client may choose:

  • A full refund, or

  • Rescheduling to a new date

We are not liable for additional costs incurred due to cancellations (e.g., flights, hotels).

4. Changes to Itinerary

4.1 Changes Requested by the Client

We will try to accommodate requests but cannot guarantee modifications after confirmation. Additional costs may apply.

4.2 Changes by the Operator

We reserve the right to adjust itineraries due to:

  • Traffic

  • Weather

  • Safety concerns

  • Attraction availability

  • Wildlife movement (for safaris)

Any changes will be made to ensure the best possible guest experience.

5. Responsibilities & Liability

5.1 Client Responsibility

Clients must:

  • Follow instructions from guides and park authorities

  • Ensure they are physically able to participate in the tour

  • Inform us of medical conditions, allergies, or disabilities prior to booking

  • Take care of personal belongings

  • Hold valid travel documents for park or border entry where applicable

5.2 Liability Disclaimer

Nairobi Heritage Tours & Safaris is not liable for:

  • Loss or damage to personal property

  • Injury, illness, or death caused by third parties or factors beyond our control

  • Delays or changes due to weather, wildlife, traffic, or government regulations

Guests participate at their own risk.

We maintain high safety standards but cannot guarantee wildlife sightings or conditions of third-party attractions.

6. Travel Insurance

We strongly recommend clients secure personal travel insurance covering:

  • Medical emergencies

  • Trip cancellations

  • Loss of property

  • Adventure activities (where applicable)

7. Park Fees & Third-Party Charges

National park fees, entry fees, accommodation charges, and visas are subject to change by government authorities.
Any increase will be passed on to the client if applicable.

8. Child Policy

Children are welcome on many tours. Age restrictions may apply depending on:

  • The tour type

  • Park regulations

  • Safety considerations

Parents/guardians are responsible for supervising minors at all times.

9. Photography & Media

We may take photos or videos during tours for promotional purposes.
If you prefer not to be included, please inform your guide before the tour begins.

Clients may take photographs, except where restricted by authorities or attraction rules.

10. Privacy & Data Protection

We collect personal information only for:

  • Bookings

  • Communication

  • Legal and safety requirements

Your data will not be shared with third parties except where necessary for tour operations.

11. Complaints & Feedback

If you have concerns during your tour, please inform your guide immediately so we can address the issue promptly.

Formal complaints may be submitted in writing via email within 7 days of the tour.

12. Governing Law

These Terms & Conditions are governed by the laws of the Republic of Kenya.
Any disputes will be resolved under Kenyan jurisdiction.

13. Acceptance of Terms

By booking or participating in a tour with Nairobi Heritage Tours & Safaris, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
